Hereinafter referred to as "the Seller"

And any natural person making a purchase via the site, hereinafter referred to as "the Customer".

 


 

Article 2 — Purpose

These GTC govern the online sales of new children's clothing offered on the Petit Bélier website.

Any order implies unreserved acceptance of these GTC.

 


 

Article 3 — Products

The products offered for sale are new children's clothing.

The essential characteristics are described on the product sheets.

The photographs are non-contractual.

Offers are valid while stocks last.

 


 

Article 4 — Price

Prices are indicated in euros (€).

VAT not applicable, article 293B of the French General Tax Code.

Delivery costs are specified before order validation.

Delivery is free in France only for any order over €79.

The Seller reserves the right to modify its prices at any time, but the rate applied is that validated at the time of the order.

 


 

Article 5 — Order

The order is placed via the website in several steps: product selection, basket verification, entry or confirmation of delivery and billing details. By clicking on "Pay", the customer declares to have read and accepted these General Terms and Conditions of Sale, accessible via the link located under the "Pay" button.

A pre-contractual summary is displayed before final validation, and a confirmation email is sent immediately after receipt of payment.

The Seller reserves the right to refuse or cancel an order for legitimate reasons, particularly in the event of product unavailability, previous dispute with the Customer, suspicion of fraud, or non-payment.

 


 

Article 6 — Payment

Payment in euros, in one go, by:

  • Bank card

  • PayPal

  • Secure payment: PCI-DSS, 3D Secure

The order is validated after payment confirmation.

 


 

Article 7 — Delivery

Delivery in metropolitan France only (excluding overseas departments and territories).

Carrier: La Poste — Colissimo. Estimated delivery time: 2 working days after payment validation. Costs are displayed before ordering and free in France only for orders over €79.

Products travel at the risk of the carrier. The Customer must check the condition of the packages upon receipt and make reasoned reservations with the carrier within 3 days in the event of damage, defect or missing items. The Seller is not responsible for delays, losses or damages attributable to the carrier (unless proven fault), nor for cases of force majeure (strikes, disasters, etc.). Article 8 — Right of withdrawal and returns

In accordance with articles L221-18 et seq. of the Consumer Code, the Customer has a period of 14 calendar days from receipt of the goods to exercise their right of withdrawal without having to justify a reason or pay penalties, excluding return costs.
Terms:

Notification by email to contact@petitbelier.com within this period, ideally via the standard form available in the Refund Policy.

Return of the product intact, unworn, unwashed, with original labels, at the expense and under the exclusive responsibility of the Customer, within 14 days following notification.

Exceptions: personalized or sealed products for hygiene reasons (art. L221-28), not applicable here unless specified.

The Seller will refund the product and the outward delivery costs within a maximum of 14 days after receipt and verification of the return, by the same payment method. See Refund Policy for complete procedures.

 


 

Article 9 — Legal Guarantees

Products benefit automatically from:

  • The legal guarantee of conformity (art. L217-4 et seq. Consumer Code): 2 years for any lack of conformity existing at the time of delivery; the Customer must notify the defect within 2 years of its discovery.

  • The legal guarantee against hidden defects (art. 1641 et seq. Civil Code): 2 years from the discovery of the defect rendering the product unfit for use.
    Any request must be made by email within 2 months of discovering the defect. Detailed procedure in the Refund Policy. The Seller replaces or repairs according to law.

 


 

Article 10 — Personal Data

The data collected (customer account, orders, emailing) are processed for order management, customer relations, and commercial communications, hosted by Shopify.

All GDPR rights (access, rectification, deletion, opposition, etc.) are detailed and exercisable via the Privacy Policy accessible in the footer. No transfer to third parties without consent, except for technical service providers.

 


 

Article 11 — Intellectual Property

All elements of the site are the exclusive property of the Seller and cannot be reproduced without authorization.

 


 

Article 12 — Applicable Law and Disputes

These GTC are subject to French law.

In the event of a dispute, the Customer must contact the Seller first for an amicable resolution.

Failing this, the Customer may free of charge refer the matter to the consumer mediator:
